Minnesota Vikings running back Adrian Peterson suffered a devastating loss this past weekend when his 2-year-old son, identified by Sioux Falls police as Tyrese Robert Ruffin, passed away from severe head injuries. Earlier, police gave an incorrect surname.

While Joseph Robert Patterson, boyfriend of Tyrese’s mother, was charged with assault and aggravated battery, prosecutors are asking that a suspended sentence be imposed for a previous domestic assault conviction, but expect to ask a grand jury to consider more serious charges in the death of the 2-year-old, the AP reports.

Lincoln County State’s Attorney Tom Wollman says he will review the autopsy and other reports before seeking any new charges against the 27-year-old.

Peterson has declined to discuss the relationship he had with the boy, who he met for the first time while the toddler was on life support, TMZ reports. Three months prior to the incident, Peterson was informed that he fathered a child in South Dakota. As a result, he took a DNA test that solidified his parenting role, then swiftly made plans to meet the toddler a few weeks ago.
