Oscar Michelen, Shyne’s lawyer, informed
Vibe.com that the new judge,
David Vaughan, was appointed on the case 10 days ago and will preside on April 26.
left Although the case has already taken strange twists, Michelen is prepared for what’s to come when it resumes.
“It’s been so hard to predict so far,” Michelen told
Vibe.com. “What will happen is there will be requests made for several motions on each side.”
Michelen said that he will be requesting the motion to free money belonging to Shyne against the
Son of Sam Law, which prevents inmates from profiting from their crimes.
On the other hand, the plaintiffs’ attorneys will be looking to place Shyne in contempt, as they claim he already spent some of his frozen assets.
The previous judge on the case, Howard Ruditzky, stepped down from presiding over the trial on March 20 after it was revealed that the same
Dershowitz and Dershowitz law firm that previously represented Shyne, also represented Ruditzy’s brother-in-law. Ruditzsky therefore stepped down to avoid a possible conflict of interest.
Michelen also revealed that the
Dershowitz and Dershowitz law firm may request motions to seek an estimated $50,000 in expenses from Shyne, their former client.
Shyne's case will be held at
Kings County Supreme Court in Brooklyn, N.Y.
