Not Her B'Day: Bey CD Pulled Over Lawsuit

With question over copyright, Sony ceases distribution of Deluxe B'Day.

Last week, soul singer Des'ree filed suit against Beyonce for allegedly covering D's track "I'm Kissing You" without proper clearance. Bey's version, "Still In Love (Kissing You)," was included on the deluxe reissue of B'Day - but according to Des'ree's suit, it was recorded without permission. Now, Bey's label has ceased distribution of the album until a May 4 injunction, according to a report by MTV News. Papers filed by Des'ree's publishers, the Royalty Network, said they had initially offered to grant Beyonce use of the song within limits. But they allege Bey's people did not respond to their offer, and that Deluxe B'Day dropped with the song - but without a signed agreement. Further, a video that was cut for the B'Day DVD, was also allegedly uncleared. (Read VIBE's interview with the video's director here.) The suit seeks $150,000 in damages.
