Suit alleges "I'm Kissing You" cover was never cleared.

British pop/soul singer Des'ree is suing Beyonce for allegedly covering D's 1998 ballad "I'm Kissing You," according to TMZ.com. In a complaint filed Tuesday in Manhattan Federal Court, Des'ree claims Bey never cleared her version of the track - retitled "Still in Love (Kissing You)" and included on the deluxe re-issue of B'Day. The suit alleges that Beyonce and reps from her record label, Columbia, initially tried to work out a deal to clear the song - which stipulated that the title could not be changed, and a video could not be cut. When Beyonce and company found Des'ree's demands unsatisfactory, says the suit, she allegedly disregarded the contract and copywrite law and cut the track. The suit seeks at least $150,000 in damages. Des'ree also wants to curb distribution of the song, video, and album.
