After being cleared of all rape charges, Derrick Rose might not be off the hook just yet. The New York Knicks point guard’s accuser has recently filed an appeal, alleging that more evidence should have been presented during trial, and the damning testimony should have been omitted.
The woman claimed she was gang-raped and drugged by the 28-year-old and two of his friends. Yet the jury declared there was not enough evidence to support her accusations. “We combed the records, looked at the transcripts and I think the judge misapplied the rape shield law and, in doing so, abused his discretion,” the woman’s lawyer, Waukeen McCoy told The Associated Press.
Rape shield laws do not allow past sexual history to be presented during rape cases. During the trial, Rose said that the unidentified woman had agreed to have sex with the three of them earlier that morning.
Since Rose was found not guilty, his legal team reportedly filed a $70,000 lawsuit against the woman for damaging Rose and his friends’ reputation.
