A grand jury began hearing evidence in the case of a former Dallas police officer who shot and killed a 26-year-old man she assumed broke into her home.
Daryl Washington, attorney for the victim’s family confirmed the grand jury hearing took place Monday (Nov. 26).
On Sept. 6, Amber Guyger, who is white shot and killed Botham Jean, a black man inside his apartment. Guyger alleges she assumed Botham-Jean was inside her apartment.
“I think it’s a mini-trial, evidence presented to the jury and hopefully come back with murder indictment,” Washington told CBS 11.
An online petition that earned 170,000 signatures urged that the manslaughter charge Guyger faces be upgraded to murder.
“We know its rare officers are indicted in Dallas, so nothing about this can be run of the mill or ordinary,” Lee Merritt, another attorney representing Jean’s family said.

A decision on whether or not Guyger will face indictment is expected for Wednesday. Weeks after Guyger was fired from the Dallas police department, Guyger’s lawyer has insisted her termination was “unfair.”
“That’s not the way our system of justice should work. It is important for all parties and the integrity of the justice system that a full and fair investigation be allowed to reach its conclusion before decisions such as this are made,” Robert Rogers said in a statement.
